The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341, 323, 353, 224, 225 and 504 of the Indian Penal Code. Prosecution case is that the accused persons attacked the police force when the police went to arrest co-accused Jai Prakash Singh, pursuant to non-bailable warrant issued against him in connection with NDPS Case No.2/97.

It is submitted by learned counsel for the petitioners that the petitioners have been roped in the present case since they happen to be the son and wife of co-accused Jai Prakash Singh. Moreover, the thrust of accusation is against co-accused

Patna High Court Cr.Misc. No.23242 of 2016 (2) dt.25-05-2016 2/2 Jai Prakash Singh. Though, petitioner no.1, Vikash Kumar Singh, is accused in one other case wherein he is on bail. A statement to that effect has been made in paragraph no.2 of the supplementary affidavit. A further statement has been made in paragraph no.3 of the petition that petitioner no.2 has no criminal antecedent.

Considering the thrust of accusation against coaccused Jai Prakash Singh, it is a case for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioners and preferably disposed of the same on the same day, if the petitioners surrender within a period of six weeks in connection with Udwant Nagar P.S. Case No.233/2012, pending before the learned Judicial Magistrate, 1st Class, Ara.

With the above observation, this application is, accordingly, disposed off.
