JUSTICE SATYAVRAT VERMA ORAL ORDER 28-01-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with Mithanpura P. S. Case No.239 of 2016, instituted for the offences under Section 290/ 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The learned counsel for the petitioner submits that the petitioner is in custody since 03.09.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of recovery of 154.575 litre of foreign liquor from a shop alleged to be of Deepak Prasad Singh and Guddu Chaudhary in which the petitioner was working.

Patna High Court CR. MISC. No.61170 of 2021(2) dt.28-01-2022 2/2 The learned counsel for the petitioner submits that on account of the fact that petitioner was working in the aforesaid shop as submitted herein above, she also came to be implicated in the present case by the police.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 03.09.2021, he is a person with clean antecedent, chargesheet has been submitted in the case and is a woman, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Mithanpura P. S. Case No.239 of 2016. The application stands allowed.
