JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-12-2022 Heard Ms. Bela Singh, learned counsel for the petitioner and Ms. Suman Kumari Singh for the State. The petitioner seeks bail in connection with Kathaiya P.S. Case No. 18 of 2022 dated 04.02.2022 instituted for the offence under Section 3/4 of the Explosive Substances Act.

Nine live bombs were recovered from the rooftop of the house of the petitioner. The petitioner denies that such recovery was made from his house. The petitioner claims that he has been made accused in this case because of his earlier implication in criminal cases. Nobody was injured while the bombs were detected, defused and taken in custody by the police.

The learned counsel for the petitioner has further submitted that in fact, if the allegations would

Be that as it may, considering the period of custody of the petitioner which is from 05.02.2022, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Muzaffarpur in connection with Kathaiya P.S. Case No. 18 of 2022.

While saying so, the Court has taken note of the fact that he has been made accused in many criminal cases in the past but in all such cases, he is on bail.
