The present writ petition has been filed seeking direction to respondent Nos. 4 and 5 to redress the claim of the petitioner with regard to grant of ACPs. which are due and not given to the petitioner, who joined on 01.07.2000 in the service on the post of Panchayat Secretary in Bhojpur District, worked on the said post in different Panchayats of the District and retired from the service on 31.01.2023 from Block Garahani and further request has been made to dispose off the claim of the petitioner in the light of the order

Patna High Court CWJC No.11889 of 2024(2) dt.12-08-2024 2/2 dated 30.05.2019 passed in CWJC No. 9093 of 2019.

Learned counsel for the petitioner submits that the case of the petitioner is squarely covered from the other similarly situated case, whose matter has been passed by this Hon'ble Court vide order dated 30.05.2019 passed in CWJC No. 9093 of 2019. He submits that in this regard the petitioner has filed representation, which is Annexure- P/4, received in the office on 17.05.2024, but no decision has been take till date.

4. Learned counsel for the State submits that the direction may be given to the respondent authorities to take a decision on the representation.

5. From the representation, it transpires that in the writ petition the petitioner has claimed to grant relief by virtue of Clause 4C of the Bihar State Litigation Policy, 2011, but in the representation he has not stated such claim.

6. As such, this writ petition is disposed off directing the petitioner to file his representation afresh before respondent No. 4 within 30 days from today and respondent No. 4 is directed to pass a reasoned and speaking order on the representation of the petitioner within 90 days thereafter.
