Petitioner seeks bail in Forbesganj (Simraha) P.S.Case No.18 of 2018 registered for the offences under Sections 25 (1b)a/26 of the Arms Act. Allegation against the petitioner is of recovery of a country made pistol, two live cartridges, a digital camera of Soni Company, three mobile phones, a Wi-Fi device, and eight ATM card.

It appears that earlier the prayer for bail of the petitioner was rejected vide order dated 5.4.2018 passed in Cr.Misc. No.19993 of 2018.

Submission of the learned counsel for the petitioner is that he has no criminal antecedent and he is in custody more than

Patna High Court Cr.Misc. No.46866 of 2018 (3) dt.19-09-2018 2/2 8 months.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M., VIth, Araria, in Forbesganj (Simraha) P.S. Case No.18 of 2018 subject to the conditions that (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in disposal of the trial and make himself available as and when required by the court, otherwise, his bail bond shall be cancelled.
