Patna High Court CWJC No.11720 of 2016 (2) dt.20-09-2016 2/2 In view of the fact that a First Information Report has already been instituted with regard to the alleged defalcation of public fund, we are clearly of the view that the extraordinary jurisdiction of this Court, under Article 226 of the Constitution of India, cannot be invoked.

In view of the above, this writ petition is closed with liberty given to the petitioner to take recourse to the appropriate provisions of law.
