JUSTICE RAKESH KUMAR ORAL ORDER 20-05-2016 Heard Sri Sanjay Kumar no.7 learned counsel for the petitioners and learned Addl. Public Prosecutor. Four petitioners, apprehending their arrest in connection with Complaint Case no.46 of 2015 for the offence under Sections 369, 406, 420, 504 and 120B of the Indian Penal Code, have prayed for grant of anticipatory bail. It was submitted by learned counsel for the petitioners that so far petitioner nos. 2 to 4 are concerned, they have falsely been implicated in the present case. Be that as it may, in view of facts and circumstances, so far as petitioner no.1 is concerned, the court proposes to dispose of the present petition granting liberty to petitioner no.1 to appear before the court below and make a prayer for regular bail. If such petition is filed, the learned court below, without being prejudiced with this order, may examine the same and pass appropriate order in accordance with law. So far petitioner nos. 2,3 and 4 are concerned, keeping in view nature of accusation as well as the fact that they are ladies , let the petitioner nos. 2,3, 4, namely, Annu Devi, Sugandhi Devi and Saraswati Devi , in the event of their arrest or surrender within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.10, 000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Complaint Case no.46 of 2015, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure (Rakesh Kumar, J) NKS/- U
