The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 399, 402, 413, 414 of the Indian Penal Code and Sections 25(1-B) a, 26, 35 of the Arms Act. It is alleged that informant received a secret information that miscreants are preparing to commit dacoity in Rajeev Gas Agency. Accordingly, a raid was conducted and five accused persons were arrested from

Patna High Court CR. MISC. No.61160 of 2021(2) dt.11-05-2022 2/3 whose possession, country made pistols, live cartridges, knife etc were recovered. The arrested persons named the petitioner as his associate who fled away from the place of arrest.

It is submitted by learned counsel for the petitioner that petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. The seized motorcycle does not belong to the petitioner. The name of the petitioner surfaced on the confessional statement of the apprehended accused persons.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VI, Sitamarhi in connection with Dumra P.S.
