The petitioner apprehends his arrest in connection with Fatua P.S. Case no. 149 of 2018, registered under Sections 147, 148, 149, 341, 323, 307, 379 and 504 of the Indian Penal Code.
The accusation is that on 17.03.2018, informant, Dinesh Ram convened a Panchayati to solve the land dispute between Bhural Ram and Vijendra Ram. In course of Panchayati, Rakesh Ram started scuffle with Dhiraj Ram then informant intervened. Thereafter, both started scuffle with the informant and also called their other family members. Thereafter, six other named in the F.I.R. including the petitioner started to cause assault to the informant. When Saroj Devi and Mantu Kumar, daughter in law and grandson of informant, rushed to save him then they ware also assaulted by
Patna High Court CR. MISC. No.59903 of 2019(3) dt.29-01-2020 2/2 them. At that time, Rakesh Ram snatched gold ear ring from Saroj Devi, daughter-in-law of the informant. Learned counsel for the petitioner submits that while petitioner is named in the F.I.R. but no specific overt act has been attributed against the petitioner and general allegation has been made against the petitioner and other of causing assault to Saroj Devi and Mantu Kumar. Further submission is that similarly situated co-accused Bhural Ram @ Bhural and three others have been granted privilege of pre-arrest bail by this Court on 01.02.2019 vide Criminal Miscellaneous No. 57308 of 2018. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri S.K. Chaudhari, J.M. 1st Class, Patna City in connection with Fatua P.S. Case No.
(2) of the Cr.P.C.
