====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 20-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Madhowrah P.S. Case No. 112/2022 registered for the offence under Sections 395 and 397 of the I.P.C.

The prosecution case, in brief, is that on 20.02.2022 at about 10.00 P.M. in the night, six unknown miscreants entered into the house of the informant and looted ornaments. It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.03.2022. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has transpired in

Patna High Court CR. MISC. No.51595 of 2022(2) dt.20-12-2022 2/2 the present case on the basis of confessional statement of coaccused. There is no recovery from the possession of the petitioner. The petitioner has not been put on T.I. Parade to ascertain his participation in the aleged occurrence. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran, Chapra, in connection with Madhowrah P.S.
