The petitioner seeks bail in Masaurhi P.S. Case No. 371/2019, instituted for offences under Section(s) 341, 448, 323, 504, 506, 308 and 34 of the Indian Penal Code. Learned counsel for the petitioner has submitted that both parties are Gotia. There is case and counter case between the parties bearing Masaurhi P.S. Case No. 372/2019. It is alleged in the written report that on the date of occurrence petitioner along with other co-accused armed with Lathi-danda and Khanti entered into house of informant and assaulted him on account of which he got head injury. Learned counsel for the petitioner has submitted that
Patna High Court CR. MISC. No.51109 of 2019(2) dt.17-08-2019 2/2 Section 308 of the Indian Penal Code has been added only to give serious colour to the offence.
Petitioner is in custody since 21.05.2019.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Masaurhi, in connection with Masaurhi P.S. Case No. 371/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
