JUSTICE MADHURESH PRASAD ORAL ORDER 09-08-2021 In view of the sudden resurgence of Covid-19 infection, there is limited functioning of the High Court and, therefore, the matter has been listed today for consideration through virtual mode.

Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by office when called upon to do so by the office. Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek bail in Bihta PS Case No. 322 of 2020, instituted for the offence under Sections

Patna High Court CR. MISC. No.7942 of 2021(2) dt.09-08-2021 2/3 147,148,149,341,323,325,307,332,333, 353, 504 and 506 of the Indian Penal Code.

There is general and omnibus allegation against the petitioners and others for commission of assault. The doctor has found fracture on right forearm and another simple injury on the driver of the police vehicle. The petitioners are in custody since 14.5.2020 having no criminal antecedents. The other co-accused persons, namely, Bakhora Kumar @ Durga Kumar and Ranjeet Bhagat of this case have been granted the privilege of bail in Cr. Misc. Nos. 2062 of 2021 and 17033 of 2021 respectively. The learned APP representing the State has opposed the prayer for bail.

Considering the period already undergone by the petitioners and completion of investigation as well as general and omnibus nature of allegation, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM -1st, in connection with Bihta P.S. Case No. 322 of 2020, subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to
