2. This application has been filed to direct the respondent authorities to remove the encroachment of old rasta i.e. Gairmajarua land of Mouza- Naurangia bearing Khata No. 105, Khesra No. 2026.

3. Learned counsel for the State has filed counter affidavit and has submitted that there is a private dispute between the parties and therefore, no encroachment proceeding can be initiated against anyone.

4. If petitioner is aggrieved, he may prefer appropriate proceeding in the Civil Court.
