Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Chhatapur P.S. Case No. 06 of 2022, registered for the offences punishable under Sections 341, 342, 323, 379, 386, 504 and 506/34 of the Indian Penal Code.
As per allegation, the informant and the petitioner were working in Ajmer as labourers. They came into contact with each other and friendship developed between them. It has further been alleged that the informant along with four

No.51611 of 2022(2) dt.19-01-2023 2/3 persons came to the village of the petitioner where the petitioner and other accused persons made pressure of marriage to one of the four persons. Thereafter, the petitioner pointed out fire arm and ordered the informant to ask his family members to transfer Rs.1,50,000/- in his account by NEFT or through Pay Phone.
Learned counsel for the petitioner has submitted that the petitioner is innocent. As a matter of fact, the informant was aware of the petitioner named as Dipak, but he was unaware that his alias name is Md. Saukat. The marriage was not possible, and it was the reason that the informant has falsely implicated the petitioner. He has submitted further that the alleged money has not been transferred in account of the petitioner.
Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Supaul in connection with Chhatapur P.S. Case No. 06 of 2022, subject to condition as laid down under section 438(2) Cr. P.C.
Patna High Court CR. MISC. No.51611 of 2022(2) dt.19-01-2023 3/3 Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
