Heard the learned counsel for the petitioner as well as the learned APP for the State.
The petitioner apprehends his arrest in connection with Dehri Nagar P.S. Case No. 425 of 2015, registered for the offences punishable under Sections 147, 149, 341, 337, 332, 353, 307 of the Indian Penal Code and Section 4 (1-a) 21 (1) DE Act and Section 40(1) of Bihar Minor Mineral Concession Rules, Section 33, 41, 42 of Indian Forest Act and Section 5 of Explosive Substance Act.
At the very outset, the learned counsel for the
Patna High Court CR. MISC. No.51624 of 2022(2) dt.19-01-2023 2/2 petitioner has submitted that the petitioner has filed an anticipatory bail petition, vide Cr. Misc. No. 17058 of 2016, but it was dismissed as withdrawn. He has submitted further that on similar ground other co-accused persons have been granted anticipatory bail.
The learned APP has submitted that the case has been lodged in the year 2015. The petitioner has come to this Court in the year 2016 for anticipatory bail which was withdrawn and again after five years, he is approaching this Court with the same prayer.
If the petitioner surrenders before the court below and makes a prayer for regular bail, that shall be disposed of on its own merit, without being prejudiced by this order. With these observations, the criminal miscellaneous petition is disposed of.
