The petitioner has preferred this application for grant of regular bail in a case registered under sections 20 and 22 of the NDPS Act and sections 25(1-B)(a) and 26 of the Arms Act. As per the prosecution case, 250 grams of ganja was recovered from the house of the petitioner. Further a country made rifle and four live cartridges were also recovered. It is submitted by learned Senior Counsel appearing for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. The house from which the alleged recoveries have been made is a joint family house. The petitioner is in custody

Patna High Court CR. MISC. No.61068 of 2021(2) dt.17-02-2022 2/2 since 13.5.2021 and has one case against him which is mainly under the SC and ST (Prevention of Atrocities) Act. It is further submitted that a supplementary affidavit has been filed stating therein about the marriage of the daughter of the petitioner being scheduled to take place on 20.2.2022.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 9 months, the Court directs the petitioner to be enlarged on bail in connection with Kargahar P.S. Case no. 102 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Rohtas at Sasaram.
