2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 126(2), 115(2), 118(1), 109, 303(2), 76, 352, 351(2), 3(5) of B.N.S.
3. The case of the prosecution is that on the order of this petitioner, the ladies of the petitioner's family assaulted the informant. It is further alleged that the petitioner along with others started assaulting with iron rod and lathi to the
Patna High Court CR. MISC. No.50225 of 2025(3) dt.16-10-2025 2/3 family members of the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the nature of allegation is general and omnibus. It has further been submitted that the petitioner and informant are next door neighbour and there is also a counter version of this case. It has also been submitted that from perusal of the injury report, it is clear that the nature of injury received by Laxminia Devi is simple whereas regarding injury of informant, opinion is reserved. It has also been submitted that the petitioner is not having allegation regarding assault to the informant. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 27.04.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sugauli P.S. Case No. 212 of 2025 on furnishing bail bond of
Patna High Court CR. MISC. No.50225 of 2025(3) dt.16-10-2025 3/3 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, First Class, East Champaran, Motihari.
