Respondent/s ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 06-09-2017 This application has been filed for restoration of First Appeal No.498 of 1998 which was dismissed for noncompliance of the peremptory order dated 6.2.2009. On 25.1.2011, notice was sent to the respondents. Office note indicates that the notice sent to respondent Nos. 1 and 2 have been received with a report that 'no such person is available on the address'. Thereafter on 27.7.2017 petitioners were granted one month time to pay process fee on correct address for the respondents. Office note dated 30th of August, 2017 indicates that no process fee has been paid in spite of time being granted on 27.7.2017. When the matter is taken up, none is present for the petitioner.

In view of the above, no further indulgence is called for in the matter.

The application is dismissed.
