The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341, 323, 379/34 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Prosecution case is that the accused persons asked the informant to cut the paddy crops, on refusal of the same the informant was abused by calling caste and assaulted. The accused persons took away Rs.450/- from the pocket of the informant.
It is submitted by learned counsel for the petitioners
Patna High Court Cr.Misc. No.23849 of 2016 (2) dt.26-05-2016 2/2 that for a petty dispute the accusation has been levelled. For the occurrence of 18.11.2011, the FIR was registered on 29.11.2011.
Delayed lodging of the FIR, constitutes ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioners and disposed of the same preferably on the same day, if the petitioners surrender within a period of six weeks in connection with SC/ST Hajipur P.S. Case No.566/2011, pending before the learned ACJM, Muzaffarpur. With the above observation, this application is, accordingly, disposed off.
