The petitioner was directed to surrender and get provisional bail within a period of four weeks by a coordinate bench (then His Lordship was) of this court vide order dated 11-04-2018 passed in Cr. Misc. No. 63290 of 2017 with certain conditions. The conditions were as per the submissions, advanced on behalf of the petitioner.
From perusal of the aforesaid order, it appears that the petitioner was to deposit an amount of Rs. 2,00,000/- (Two lacs) at the time of furnishing bail bond for grant of provisional anticipatory
Patna High Court CR. MISC. No.10975 of 2021(2) dt.23-02-2022 2/2 bail within a period of four weeks and the remaining amount of 6,20,000/-, out of Rs. 8,20000/- was to be deposited by him in four equal installments. No part of that order had been complied with by the petitioner. Therefore, the petitioner preferred Modification Application vide Cr. Misc. No. 3720 of 2020 seeking an extension of time for complying with the order dated 11-04-2018 in Cr. Misc. No. 63290 of 2017 passed by the then coordinate bench of this court. The said modification application was allowed granting further three months' time by another coordinate bench of this court. Now the present modification application is in respect of modification of the first modification order passed in Cr. Misc. No. 3720 of 2020 dated 02-07-2020 by which the petitioner was granted three months' time.
I find no reason to entertain this application. The present application is nothing but an abuse of process of the court because since 2018 till date, the petitioner has not even made part compliance of the first order passed in Cr. Misc. No. 63290 of 2017, dated 11-042018 by the then coordinate bench of this court. Accordingly, the present modification application stands dismissed.
