Mr. Sri Amitesh Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-07-2018 Heard the learned counsel for the petitioner, the informant and the State.

The petitioner seeks bail in anticipation of his arrest in connection with Tajpur (Halai) P.S. Case No. 82 of 2018 dated 17.03.2018 instituted for the offences under Sections 341, 324, 326, 307 and 504/34 of the Indian Penal Code.

The informant and his daughter-in-law are alleged to have been assaulted by some unknown persons and which act of assault was witnessed and supported by other unknown persons as well.

The cause of occurrence, as has been stated in the F.I.R., is that the petitioner and his father are having dispute with his son, who had gone missing from his house. The aforesaid dispute is with respect to

No.42056 of 2018(2) dt.23-07-2018 2/2 apportionment of the compensation amount which has been given or is about to be given by the government for acquisition of land of the petitioner. In the aforesaid context, the informant has alleged that the petitioner and other co-villagers have been abetting such an offence by his son.

Regard being had to the fact that no specific accusation has been levelled against the petitioner and his implication in the present case is only on the basis of suspicion of the informant of his giving a helping hand to the son of the informant, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Samastipur in connection with Tajpur (Halai) P.S. Case No. 82 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
