Mr. Sri Manoj Kumar - 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-07-2018 Heard the learned counsel for the petitioners, the informant and the State.

The petitioners seek bail in anticipation of their arrest in connection with Bakhtiyarpur P.S. Case No. 263 of 2017 dated 12.07.2017 instituted for the offences under Sections 147, 148, 447, 341, 323, 307 and 427 of the Indian Penal Code.

The petitioners along with others are alleged to have assaulted the informant, leading to injuries on his person.

Petitioner No. 1 is also said to have filed a case against the informant of the present case vide Bakhtiarpur P.S. Case No. 264 of 2017 and in the aforesaid case, the accused, who is the informant of the

Patna High Court Cr.Misc. No.42095 of 2018(2) dt.23-07-2018 2/2 present case, has been granted anticipatory bail. Similarly situated accused persons of this case have also been granted anticipatory bail by a Bench of Court. Regard being had to the aforesaid facts, as also taking into account that the occurrence took place because of admitted land dispute, the petitioners abovenamed are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Barh, District - Patna in connection with Bakhtiyarpur P.S. Case No. 263 of 2017, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
