The petitioner apprehends his arrest in Belhar P.S. Case No. 73 of 2011, registered for the offences punishable under Section 364A and some other Sections of the Indian Penal Code. The petitioner, of course, not named in the FIR, but the name of the petitioner figured in the case in the statement of the victim. The victim disclosed that the accused persons were talking with each other by name.

Considering the facts aforesaid and nature of allegation made against the petitioner that the petitioner has played role in kidnapping of the victim, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. However, the petitioner is directed to surrender

Patna High Court Cr.Misc. No.2205 of 2015 (2) dt.21-01-2015 before the court below within four weeks and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
