JUSTICE SHIVAJI PANDEY ORAL ORDER 07-04-2021 Heard learned counsel for the petitioner and learned counsel for the State through video conferencing. In this case, the petitioner is seeking regular bail in connection with Murliganj P.S. Case No. 135 of 2019 registered for offence punishable under sections 364, 302, 201/34 of the Indian Penal Code.

As per FIR, while the uncle of the informant along with the informant and two other persons had gone to visit Mela and they were watching orchestra, in the meantime, the accused persons including the petitioner came there and forcibly took away the uncle of the informant in a Bolero vehicle. In the next morning, the dead body of the uncle of the informant was found at Benga Ghat.

This Court vide order dated 05.06.2020 in Cr. Misc. No.3792 of 2020 rejected the bail of the petitioner.

No.8502 of 2021(3) dt.07-04-2021 2/2 Learned counsel for the petitioner submits that one Binod Yadav against whom identical allegation has been made, moved before the Hon'ble Supreme Court in Criminal Appeal No.643 of 2020 and he had been granted bail. Apart from that other co-accused persons against whom identical allegation has been made, have also been granted bail by different coordinate Benches of this Court.

Looking to the entirety of the matter, let the petitioner above named be also released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No. 135 of 2019, subject to the condition that one of the bailors of the petitioner shall be his close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. In case of failure on two consecutive dates without any valid reason, the court below will have liberty at liberty to cancel the bail bonds of the petitioner.
