Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 413, 414, 419, 420, 467, 468, 471 and 34 of the Indian Penal Code, registered in connection with Muzaffarpur Sadar P.S.Case No. 585 of 2020. The informant is Sub-inspector of Police. He got an information that co-accused Rajesh Kumar @ Bantha and Govind Kumar @ Dhatura along with other accused persons

Patna High Court CR. MISC. No.61510 of 2021(2) dt.18-07-2022 2/3 including the petitioner, were indulged in committing theft of motor-cycles and sale thereof after changing the number plates and tampering with the engine numbers. On raid, co-accused Rajesh Kumar @ Bantha and Vishal Kumar were arrested with stolen bike and they disclosed the name of the present petitioner. The learned counsel for the petitioner has submitted that he is innocent. His name has figured only in the confessional statement of co-accused and nothing was recovered from his possession.

On the other hand, the learned APP has opposed the prayer for anticipatory bail.

In paragraph no.3 of the bail petition, criminal antecedent of the petitioner has been mentioned which shows that Bela P.S.Case No. 36 of 2020 is also pending against the present petitioner which case is of similar nature. The learned counsel for the petitioner has submitted that the petitioner is on bail in the said case. Considering the above facts and circumstances as well as the criminal antecedents of the petitioner, I do not think it a fit case for anticipatory bail to the petitioner. His prayer for anticipatory bail is hereby rejected.
