Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 5.10.2018 passed in Cr. Misc. No.52280 of 2018 and there is allegation of recovery of looted articles from the house of the petitioner . Submission of the learned counsel for the petitioner is that the petitioner is in custody for more than one year and up till now only charge has been framed and in this case no witness has been examined.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the

No.48864 of 2019(2) dt.07-08-2019 2/2 like amount each to the satisfaction of the learned SDJM, Barh (Patna) in connection with Athmalgola P.S.Case No.46 of 2018 with condition that bailors should be local one and before releasing the petitioner, the address of the petitioner as well as of the bailors shall be verified and further condition that he has to appear before the trial court as and when required except showing some genuine reason otherwise his bail bond shall be cancelled..

With the aforesaid direction, this application is allowed.
