JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-09-2021 The instant case has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.
Heard the learned counsel for the petitioner and Sri Dasrath Mehta, the learned APP for the State. The present petition is by way of third attempt at the behest of the petitioner for grant of regular bail in connection with Barhat PS case no. 71 of 2016 under Sections 353, 120B, 121, 121A of Indian Penal Code, Sections 25(1-B)a, 26, 27 of Arms Act, Sections 16, 18, 20, 21 of U.P.A. Act and 3/4 of Explosive Substance Act, inasmuch as the prayer of the
Patna High Court CR. MISC. No.9460 of 2021(4) dt.17-09-2021 2/2 petitioner for grant of regular bail has been rejected earlier on two occasions, nonetheless the fact remains that the petitioner is languishing in custody since 18.12.2016 and the charges have also not yet been framed.
At this stage, the learned counsel for the petitioner seeks to withdraw the present petition with liberty to move this Court for grant of bail after one year, in case there is no progress in the pending trial before the learned lower court. Liberty so sought, is granted Accordingly, the present petition stands disposed of as not pressed, however with a direction to the learned court of A.D.J. 1st, Jamui to ensure that charges are framed in the connected Sessions Trial No. 312 of 2017 (arising out of Barhat PS case no. 71 of 2016) within a period of three months from today, failing which this Court shall be constraint to take appropriate action.
