It is submitted that petitioner no. 4 Mahendra Rai has been arrested and as such his prayer for anticipatory bail has become infructuous.
This application is dismissed as infructuous, so far petitioner no. 4 is concerned.
The other petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 283, 323, 307, 337, 353, 504 of IPC.
Allegation against petitioners and others is to have
Patna High Court Cr.Misc. No.31188 of 2014 (4) dt.20-01-2015 2/3 raised slogan, jammed the road and put obstruction by burning tyre and also started brick batting.
It is submitted that the petitioners have been named only on suspicion. They have no criminal antecedent. There is no specific allegation against the petitioners.
Considering the facts and circumstances, in case of arrest or surrender within a period of four weeks the above named petitioner nos. 1 to 3, namely, Mahesh Rai, Prabhu Yadav @ Prabhu Rai and Pramod Das will be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Sikrahana at Motihari in Chiraiya(Sikarganj) P. S. Case No. 132 of 2013, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure and the other following conditions:-
1. The petitioners will not indulge themselves in similar or any other offence.
2. One of the bailors must be the close relative of the petitioners.
3. The petitioners will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, their bail bond
Patna High Court Cr.Misc. No.31188 of 2014 (4) dt.20-01-2015 3/3 would be liable to be cancelled by the learned Court concerned.
