JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Dulhin Bazar Police Station Case No. 204 of 2015 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 283, 332, 333, 307, 353, 427, 152 and 504 of the Indian Penal Code.
Admittedly, petitioner was not caught on the spot and his name was disclosed by those persons, who were caught on the spot.
Submission on behalf of the petitioner is that having more or less similar allegation, several co-accused including Chhotan Yadav and others have already been granted privilege of
Patna High Court Cr.Misc. No.24580 of 2016 (2) dt.13-06-2016 2/2 anticipatory bail by different Benches of this Court. Taking note of the aforesaid submissions as well as this aspect of the matter that petitioner does not have any criminal antecedent, let petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Danapur, Patna in Dulhin Bazar Police Station Case no. 204 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C.
