The petitioners apprehend their arrest in connection with Kalyanpur P.S. Case No.18 of 2022, registered for the offences punishable under Sections 341, 323, 324, 427, 379, 307, 384 and 34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. The petitioners have got one criminal antecedent
Patna High Court CR. MISC. No.52120 of 2022(2) dt.14-12-2022 2/2 as stated in paragraph-3 of the bail application. It is further submitted that there is admitted land dispute between the parties. It is submitted that there is general and omnibus allegation against the petitioners. It is also submitted that from perusal of the impugned order, it is clear that the injuries are simple in nature.
Learned APP for the State as well as learned counsel for the informant opposed the prayer for anticipatory bail of the petitioners.
Considering the nature of injury, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-9, Motihari, East Champaran in connection with Kalyanpur P.S. Case No.18 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
