JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-05-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 354, 504, 379, 34 of the Indian Penal Code.

The prosecution case is that on 10.10.2015 petitioner and co-accused Pappu Yadav borrowed Rs. 30,000/- from the son of the informant namely Krishna Kumar but they did not return the same. On 13.02.2016 when the son of the informant demanded his money back then he was threatened to implicate in the false case. On 16.02.2016 the informant came to know that accused persons have lodged a case against her son then she went to the house of the accused persons but co-accused Mira Devi assaulted her with fists and legs and this petitioner pulled her sari, co-accused Pappu Yadav pushed her towards the wall and co-accused Mira Devi snatched gold chain of the informant.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.24508 of 2016 (2) dt.31-05-2016 2/2 petitioner that the case lodged by the petitioner's side is one week prior to lodging of the present case and the informant has retracted from the initial version and has filed a petition to that effect before learned Court below.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case No. 128 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
