Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 452, 420, 467, 468, 471, 380, 341, 342, 323, 324, 307, 504, 506 of the Indian Penal Code and 26 of the Arms Act and 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act. The prosecution case is that the petitioner and others attacked on the land of Bihar State Religious Trust Board, made assault to the inhabitants, abused them by calling caste name and damaged the property in order to take forceful possession of the property on the point of fire-arm. It is further submitted that others have been granted bail. Though the petitioner has been roped in several cases
Patna High Court Cr.Misc. No.23600 of 2016 (2) dt.25-05-2016 maliciously due to politics of concerned police officers. In view of the accusation against the mob, it is a case for consideration of prayer for regular bail, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Gandhi Maidan P.S. Case No. 150 of 2016, pending in the court of learned Smt. Supriya Goswami, J.M., Ist Class, Patna. With the above observation this application is disposed of.
It is expected from the learned court below to dispose of the regular bail application of the petitioner preferably on the same day.
