JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406, 504, 506 of the Indian Penal Code.
Prosecution case is that the informant was persuaded to install a crusher unit in partnership of the petitioner for which the informant invested Rs.1,50,000/- for taking the land on lease and thereafter Rs.4,00,000/- for establishing crusher unit when it was agreed that petitioner will run the crusher unit initially for two years and thereafter, it will be run by the informant, but after completion of two years, the petitioner did not hand over the crusher unit to the informant.
It is submitted by learned counsel for the petitioner that there is nothing on record to suggest that the petitioner entered
Patna High Court Cr.Misc. No.24028 of 2016 (2) dt.30-05-2016 2/2 into any agreement nor there is any proof with regard to payment made to the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned I/c ACJM-1, Rohtas at Sasaram, in connection with Kochas (Parsathua) P.S. Case No.26/2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
