The petitioner seeks bail in connection with Shikarpur P.S. Case No. 224 of 2023 registered for the offence under Sections 363, 366A, 34 and 8/12 of the POCSO Act. However, the police has found the occurrence to be true also under Section 376 of the Indian Penal Code.

From reading of the F.I.R. it appears that the victim girl who is alleged to be around 17 years had eloped with the petitioner and stayed with him for 3-4 months. Learned counsel for the petitioner submits that the petitioner is in custody since 15.04.2023.

Considering the period of custody, this application for regular bail is allowed.
