The petitioners, being mother and brothers wife of the husband of the victim, are apprehending arrest in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.
The prosecution case got initiated on the basis of written report dated 02.11.2017 submitted by one Gopal Paswan to the Station House Officer, Sangrampur Police Station, East Champaran to the effect that on 31.10.2017 at 10.00 A.M, the informant received information through mobile that her daughter Chameli Devi has been killed and her dead body has
Patna High Court Cr.Misc. No.43672 of 2018(2) dt.23-07-2018 2/3 been thrown somewhere. On receiving such information, the informant went to in-laws house of the victim where her daughter was found missing. However, some villagers conveyed him that perhaps his daughter has been killed by the in-laws and her dead body has been thrown. It is further alleged that petitioners used to demand Rupees Fifty Thousand as dowry from the victim. The husband of the victim is having illicit relationship with petitioner no.2, Rajmati Devi, which was protested by the victim, hence she has been killed. It is submitted by learned counsel for the petitioners that the accusation has been levelled only on suspicion. There is no eye witness to the occurrence. Petitioners are ladies. Admittedly none has seen the occurrence.
The police has also not ascertained this fact whether the victim is dead or alive. A statement has been made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent. It is submitted by learned APP for the State that the accusation is specific against the petitioners in the FIR.
