2. The petitioner seeks regular bail in connection with Maker P.S. Case No.100 of 2023 lodged under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per the prosecution case, the F.I.R. has been lodged against two named accused persons including the petitioner against whom total recovery of 80 liter wine has alleged to be made, which is subject matter of the present case.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the petitioner has not been apprehended from the place of occurrence and the petitioner is not owner of the vehicle from where the said recovery has been made.

5. Counsel submits that due to dirty village politics and suspicion, the petitioner's name has been figured in this case.

6. Counsel for the petitioner submits that petitioner is in custody since 11.06.2024 having four criminal cases pending against him.

7. Learned counsel for the State opposes the prayer for bail.

8. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail, 3 months after framing of charge, if not framed on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Exclusive Special Excise Court, Saran at Chapra in connection with Maker P.S. Case No.100 of 2023, subject to the following conditions as laid down under Section 437(3) of Cr.P.C.
