Petitioner apprehends his arrest in connection with Paliganj P.S.Case No. 80 of 2017 registered for the offences punishable under Sections 420, 406 and 409 of the Indian Penal Code.
Allegation against the petitioner is of irregularity in the MNREGA works in between the period 2002-10 and FIR has been lodged in 2017.
Submission of learned counsel for the petitioner is that no specific allegation has been attributed against him, rather specific allegation is against Mukhiya and Panchayat Sewak and moreover similarly situated co-accused has been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order
Patna High Court Cr.Misc. No.47452 of 2018 (2) dt.14-08-2018 2/2 dated 15.1.2018 passed in Cr.Misc.No. 52472 of 2017. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Danapur, in connection with Paliganj P.S.Case No. 80 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
