JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Dharhara P.S. Case No. 47 of 2007 for the offence under Sections 147, 148, 149, 364, 302, 323, 324/201 of the Indian Penal Code, Section 17 of the C.L.A. Act and Section 13 of the U.A.P.A. Act. Learned counsel for the petitioner submits that the petitioner is a man of clean antecedent and he is employed in Railway. He further submits that from the case diary, it appears that the petitioner was the member of unlawful assembly, who committed the mischief in the instant case. The petitioner is in custody since 01.04.2018.
Considering the fact that the petitioner has no criminal antecedent and he is employed in Railway and also the fact that the petitioner is in custody since 01.04.2018, the
Patna High Court Cr.Misc. No.35302 of 2018 (3) dt.23-07-2018 2/2 petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction Additional Chief Judicial Magistrate, Munger in connection with Dharhara P.S. case no. 47 of 2007 with the condition that the bailors should be the employee of the Railway.
