Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the Accountant General. The petitioner retired as a 'Nalkoop Khalasi' from Munger on 28.02.2018. In the instant writ petition, he has raised a claim for grant of benefit under the Assured Career Progression Scheme ( for short ACP).
The respondent No.2 (Executive Engineer, Department of Building Construction, Govt. of Bihar, Patna) has filed a counter affidavit and it is their stand in paragraph No.5 that for the
Patna High Court CWJC No.15529 of 2019(3) dt.15-06-2020 2/2 purposes of grant of benefits under 1st, 2nd and 3rd ACP w.e.f. 01.01.1996, 01.01.2006 and 01.01.2016 respectively, the petitioner's claim has been sent to the District Accounts Officer, Munger along with his original service book by letter No. 2084 dated 01.11.2019 Annexure -A to the counter affidavit for verification of the same.
Since the Authorities have taken the requisite steps for grant of due and admissible benefits to the petitioner, no adjudication is called for.
The writ petition is disposed off with a direction to the Respondent No.2 to ensure that the requisite steps for grant of due and admissible benefits to the petitioner are taken expeditiously to its logical conclusion within a period of eight
(08) weeks from the date of receipt/production of a copy of this order. The petitioner should be granted the actual payments found due and admissible within a period of four (04) weeks thereafter.
