The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 414 of the Indian Penal Code and 7 of Essential Commodities Act. The prosecutions case is that on information 150 quintals of Arwa rice were recovered from a truck from Gaya Dovi road.
It is submitted by learned counsel for the petitioner that the accusation has been levelled only on the basis of suspicion. The said rice has been claimed by one Lakchami Sao and truck and the seized rice have been released in pursuance to the order 11.05.2016 passed in C.W.J.C. No. 7565 of 2016 by a
Patna High Court Cr.Misc. No.24308 of 2016 (2) dt.31-05-2016 2/2 Co-ordinate Bench of this Court.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner above named in the event of his arrest or surrender before the Court below within a period of twelve weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Magadh University P.S. Case No. 24 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
