JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-07-2018 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Civil Line P.S. Case no. 334 of 2017 for the offence registered under Sections 420 and 406 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He further submits that in the instant case petitioner is in custody since 18.04.2018. He also submits that the instant case was registered after five months of the alleged occurrence. He submits that in the instant case not even a single person, who deposited the amount have been not examined.
Considering the delay of five months lodging the fardbeyan and fact petitioner has got no criminal antecedent and
Patna High Court Cr.Misc. No.35609 of 2018(3) dt.23-07-2018 2/2 he is in custody since 18.04.2018, let the petitioner, named above is directed to be released on bail on furnishing bail bond of Rs.10000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Gaya in connection with Civil Line P.S. Case No. 334 of 2017.
