The petitioner being the husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code.
Basic accusation is of causing burn injury and making attempt to throttle the complainant.
It is submitted by learned counsel for the petitioner that the victim died at her parents' house on 12.08.2012 due to illness. There is no injury report of the victim on record. Considering the fact that the complaint has been filed
Patna High Court Cr.Misc. No.25022 of 2016 (2) dt.26-09-2016 2/2 in 2011 when the present application has been preferred on 07.06.2016, let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Complaint Case No.678/2011, pending before the learned CJM, Kaimur at Bhabua.
With the above observation, this application is, accordingly, disposed off.
