2. The petitioner apprehends his arrest in a case registered for the offence under Sections 406, 420/34 of the Indian Penal Code.
3. It is alleged that this petitioner alongwith other coaccused persons sold a land in favour of wife of informant for a consideration amount of Rs. 15,00,000/-, but during mutation, informant came to know that the land in question has already been sold to some other persons and when informant demanded his money, he was threatened by petitioner and other co-accused persons.
4. Learned counsel for the petitioner submits that specific accusation is against co-accused Geeta Devi and her
Patna High Court CR. MISC. No.56485 of 2024(5) dt.14-07-2025 2/2 sons. Neither the petitioner has taken any money from informant nor executed sale-deed. Petitioner is only alleged to be witness of alleged sale-deed agreement and has only put his signature on the agreement. Moreover, the dispute involved in the present petition is purely of civil nature and none of the acts allegedly committed by the petitioner give rise to any criminal liability.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Sherghati, Gaya in connection with Sherghati P.S. Case No. 613 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
