2. The present petition has been preferred for the: issuance of writ of mandamus or any other writ or writs, direction or directions commanding upon the Respondent No. 6, the Anchal Adhikari, Dharhara, Anchal Dharhara, Dist. Munger not a disposes the petitioner from his

Patna High Court CWJC No.11994 of 2023(2) dt.07-05-2024 2/3 raiyati land bearing Khesra No. 542 of Khesra No. 19 situated in Mauza Mangarh, P.S & AnchalDharhara, Dist. Munger, Thana No. 317, Tauzi No. 445, who wants to give possession of petitioner land to the Respondent No. 7 namely Parmanand Jha without any order of any court rather on the basis of claim made by Respondent No. 7 in Janta Darbar presided by Anchal Adhikari, Dharhara.

3. At the outset, learned State Counsel pointed out that in the writ petition, allegation has been made against the Circle Officer, Puja Kumari without impleading her as partyrespondent and as such, the writ petition is fit to be dismissed for non-joinder of the necessary parties.

4. He further with the help of paragraph-12 of the counter affidavit submits that the B.L.D.R. Case No. 07 of 2022-23 is pending before the Deputy Collector Land Reforms, Munger where the parties have already appeared.

5. Though, this case is fit to be dismissed for nonjoinder of the necessary parties, in view of the fact that the B.L.D.R. Case is pending before the D.C.L.R., the petitioner if so want can pursue and take the said case to its logical conclusion.

6. Learned Counsel for the petitioner submits that he will be actively pursuing the said B.L.D.R. Case.
