The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 376, 313 and 506/34 of the Indian Penal Code.

As per prosecution case, the informant alleges that coaccused Pankaj Kumar was exploiting her sexually since last six years on the allurement of marriage and when she conceived about seven months ago, she gave pressure on him to marry and then on 25.03.2019, the said co-accused along with his brother and his family members got her pregnancy aborted by the doctor against her will and they were also giving threatening to kill her. Patna High Court CR. MISC. No.51947 of 2019(3) dt.16-11-2019 2/3 petitioner has falsely been implicated in this case due to local party politics. There is general and omnibus allegation against this petitioner. It is further submitted that entire allegation is against co-accused Pankaj Kumar who has already been granted anticipatory bail by a coordinate Bench of this Court in Cr.Misc.No.56894 of 2019 dated 09.09.2019. Petitioner is simply the brother of co-accused Pankaj Kumar. In the aforesaid facts and circumstances, let the above named petitioner be released on bail in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.

10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Biharsharif, Nalanda/successor Court in connection with Mahila P.S.Case No.33 of 2019, with following conditions:- (i) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the court below.
