JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 448, 341, 323, 324, 379 and 308/34 of the Indian Penal Code. The accusation is of making assault to the informant. It is submitted by learned counsel for the petitioner that the accusation of making assault is omnibus and general and except one, other injuries have been found to be simple. Moreover, at earlier point of time, petitioner no.1 lodged Complaint Case No. 1330 of 2014 for the offences punishable under Sections 323, 354 and 376/511 of the IPC against the present informant and the informant of the present case also filed a case before the LDCR with regard to land dispute which was decided in favour of the petitioners. A statement has been made in para 3 of the petition
Patna High Court Cr.Misc. No.1862 of 2015 (2) dt.16-01-2015 2/2 that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Begusarai in connection with Bachhwara P.S. Case No. 152 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
