JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 07-09-2021 Heard the parties through virtual court proceedings. Vide order dated 24.06.2021, report was called for from the court of learned Additional Session's Judge-VI, Patna S.Tr. No. 494 of 2018 (C.I.S. No. 4940 of 2018) arising out of Rajeev Nagar P.S. Case No. 230 of 2017 regarding stage of trial in the present case which is received and tagged as Flag "R" to this petition. In compliance thereof, a report dated 15.07.2021 sent by the Additional District and Sessions Judge -XI, Patna has been received and at Flag "R" to this application. Learned Judge, apart from the other facts, has stated that in this case till now charge has not been framed because of non appearance of the accused persons. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. The prayer for bail of the petitioner is rejected.

No.9209 of 2021(3) dt.07-09-2021 2/2 However, the learned Trial Court is directed to conclude the trial as expeditiously as possible preferably within one year from the date of receipt/production of a copy of this order and S.P., Patna is directed to ensure production of the witnesses in the case on each and every date fixed without fail.

Let a copy of this order be communicated to S.P., Patna by fax for needful.

If the trial is not concluded within the stipulated period, as aforesaid, the petitioner would be at liberty to renew his prayer for bail.
