====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 12-12-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.
Learned counsel for the petitioners is directed to remove the defects within four weeks.
The petitioners apprehend their arrest in a case registered for the offence punishable under section 341, 323, 379, 326, 307, 504, 34 of the Indian Penal Code.
Allegedly, the petitioners are said to have thrown acid on the informant, snatched Rs. 20,000/- and mobile phone from his pocket, and also threatened to kill him.
It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence.
Patna High Court CR. MISC. No.51389 of 2022(2) dt.12-12-2022 2/3 They have been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. The petitioners have two criminal antecedents as mentioned in para three of the bail application. Learned counsel for the petitioners further submits that during the investigation the police has filed a final form against the petitioners and the final form was accepted by the Court below. Thereafter, the informant filed Cr. Revision No.127 of 2021 against the order accepting the final form and the learned A.D.J.-II, set aside the order of C.J.M. and took cognizance against the petitioner.
Learned APP for the State opposed the prayer for anticipatory bail.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Brahampur P.S. Case No. 338 of 2020, subject
