2. The petitioner seeks pre-arrest bail in connection with Bairgania P.S. Case No. 93/2024 registered for the offence(s) punishable under Sections 279 and 304A of the Indian Penal Code and Sections 30(a) and 30(c) of the Bihar Prohibition and Excise Act.
3. As per the allegation made in the FIR, 98.7 litres of illicit liquor was recovered from a car bearing Registration No.BR-06R/0324, which met with an accident, in which driver of the said car died.
4. Learned counsel appearing on behalf of the petitioner submitted that petitioner is innocent and has falsely
Patna High Court CR. MISC. No.53780 of 2024(4) dt.17-01-2025 2/2 been implicated in the present case. It is further submitted that neither the vehicle is registered in the name of the petitioner, nor he is engaged in the trade of illicit liquor in the State of Bihar.
5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail and submitted that petitioner has got criminal antecedents of six cases and that too under Excise Act.
6. Considering the nature of allegation, as well as, the fact that petitioner has criminal antecedent of six cases under Excise Act, I am not inclined to grant pre-arrest bail to the petitioner. Accordingly, the present bail application stands dismissed.
