JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-01-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Kaluahi P.S. Case No. 120 of 2014 registered for the offence under Sections-419, 420, 406, 467, 468, 471 of the Indian Penal Code.

Admittedly, at the relevant time, the petitioner was Surpanch of the Gram Kuchery and according to prosecution case, a merit list of Nyay Mitra was prepared and only five days time for joining, was given to selected candidates violating Gram Kuchery Rules. Thereafter, some cuttings were made and ten days time was given to concerned candidates to join their posts. The accusation against the petitioner is that he granted permission to

It would appear from perusal of inquiry report of concerned SDO that it was the Secretary who made cuttings in relevant documents. Considering the aforesaid facts and circumstances as well as submission of the parties, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kaluahi P.S. Case No. 120 of 2014 to the satisfaction of Chief Judicial Magistrate, Madhubani subject to conditions as laid down u/S 438(2) of the Cr. P.C.
